Terms of Service

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.

To access most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately at [email protected] if you suspect unauthorised access to your account.
• Be responsible for all activity that occurs under your account.

Each account is for a single individual. You may not create multiple accounts to circumvent plan limits, restrictions, or suspensions.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Cheat on any exam, test, or academic assessment (see Section 4).
• Attempt to reverse-engineer, decompile, or tamper with the desktop application or website.
• Circumvent any access controls, licensing checks, or security features.
• Use automated scripts, bots, or tools to access the Service in a manner not intended.
• Resell, sublicense, or commercially distribute access to the Service without our written consent.
• Transmit malware, spam, or any harmful or disruptive content.
• Impersonate another person or entity.
• Interfere with or disrupt the Service or its infrastructure.

We reserve the right to investigate suspected violations and to suspend or terminate accounts without warning if we determine, at our sole discretion, that these Terms have been violated.

This section constitutes a core, non-negotiable condition of your right to use the Service.

Certain features of the Service require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan) and are processed by our payment provider, Polar.

• Billing cycle: Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.
• Price changes: We may change subscription prices with at least 30 days' prior notice. Continued use after the price change takes effect constitutes acceptance of the new price.
• Cancellation: You may cancel your subscription at any time from Dashboard → Account → Manage Subscription. Cancellation takes effect at the end of the current billing period; you retain access until then.
• Taxes: Prices may be exclusive of applicable taxes, which will be calculated and added at checkout based on your location.

We offer refunds within 7 days of purchase if the desktop application does not function on your device and our support team is unable to resolve the issue within a reasonable timeframe.

Refunds are not available for:

• Change of mind after a subscription has been active for more than 7 days.
• Accounts terminated for violating these Terms.
• Partial billing periods after cancellation.

The Service, including the website, desktop application, design, code, branding, and all content created by Testbudy, is owned by or licensed to Testbudy and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial study purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or sublicense any part of the Service without our prior written permission.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or completeness of any AI-generated content produced by or through the Service.

AI-generated content is not a substitute for professional advice. Always verify important information independently.

To the fullest extent permitted by applicable law, Testbudy and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your use of or inability to use the Service
• Any academic, professional, or disciplinary consequences resulting from your use of the Service
• Unauthorised access to or alteration of your data
• Any bugs, errors, or inaccuracies in the Service

In no event shall our total liability to you exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or £50 (GBP), whichever is greater.

You may close your account at any time from Dashboard → Account Settings.

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we believe you have violated these Terms — in particular the Academic Integrity Policy in Section 4. Termination for cause does not entitle you to a refund.

Upon termination, your licence to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, and governing law) shall survive.

These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction in which Testbudy is established, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or by displaying a notice on the website at least 14 days before the changes take effect.

Your continued use of the Service after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.
